Comments: Approximately 100 independent Commissioners carry out frequent, short notice and unannounced visits (usually alone) to all NHS and Independent mental health providers in England and Wales where patients may be detained under the Mental Health Act 1983. The role of Commissioners is to check the legality of detentions and to interview patients in private to ascertain whether they are being treated appropriately and within the law. The Mental Health Act Commission often raises issues with ward managers and other staff on behalf of patients, and seeks to resolve these wherever possible at the time of the visit. Visits made by Commissioners monitor compliance with the Mental Health Act 1983 and Code of Practice. To do this Commissioners interview detained patients in private, scrutinise records, and assess factors that affect the care, treatment and quality of life provided to detained patients including environmental, organisational, and equality and Human Rights issues. The primary aim of any visit is to ensure the lawfulness of detention and to monitor the operation of the Act as it relates to detained patients. The Commission hopes that through its actions it can make a real difference to the lives of detained patients. Large NHS Trusts may be visited a number of times a year at different wards or sites. A smaller provider will be visited less frequently. The frequency of visits will depend on a number of factors including the number of detained patients, type of unit, ongoing or unresolved issues and information from other regulators. The Commission does not issue a formal report following each visit but information from all visits is collated and monitored to inform the Annual Report to the Provider. The Commission's Annual Reports are posted on its website (www.mhac.org.uk) once issued in final.
