Mental Health Act Monitoring



The Mental Health Act Commission was disbanded on 31st March, as part of the establishment of the new Care Quality Commission in England. Its functions in Wales have been returned to Welsh Ministers and will be undertaken on their behalf by Healthcare Inspectorate Wales.

In future reviewers from HIW will be visiting wards to meet detained patients, examine records and talk to staff in order to keep the use of the Mental Health Act 1983 under review and check that the Act is being used properly. Individual organisations will receive reports, and HIW will also be making an annual report to the National Assembly.
 
HIW are also now responsible for providing a Second Opinion Appointed Doctor (SOAD) service.
